No Criminal Charge

Client had taken his gun off while loading equipment, putting it in a backpack, on the equipment car. Unbeknownst to him, the pack fell off the cart during set-up, and was found by a third party, who looked in the pack to try and identify the owner. The gun was found, police were called, and the criminal complaint procedure began.

As I explained to a fair police prosecutor and reasonable clerk magistrate, my client, a man with no record, working two jobs, was not a menace. The clerk-magistrate chose not to treat an accident - a pack falling off a cart - as a crime, and dismissed the complaint.  The client is, as you would expect, quite relieved.
